Con la l. cost. n. 2 del 2001 è stata attribuita alle autonomie speciali la possibilità di introdurre l’elezione diretta del Presidente della Regione e di determinare la propria forma di governo, istituendo contestualmente una nuova fonte normativa, la c.d. legge statutaria. Con la sentenza n. 211 del 2025, la Corte costituzionale ha ritenuto applicabile anche alle autonomie speciali il limite dei due mandati elettivi consecutivi del Presidente della Regioni, già affermato, con riferimento alle Regioni ordinarie, nella sentenza n. 64/2025. Il presente contributo si propone di ricostruire l’evoluzione della forma di governo nelle autonomie speciali, al fine di stabilire se le autonomie speciali possano qualificarsi come laboratori istituzionali nei quali declinare il principio democratico in coerenza con le esigenze, le peculiarità e le traiettorie storico‑istituzionali dei rispettivi territori.
With Constitutional Law No. 2 of 2001, the autonomous regions were granted the power to introduce the direct election of the president of the region and to determine their own form of government, while at the same time establishing a new source of law, the so-called statutory law. In Judgment No. 211 of 2025, the Italian Constitutional Court held that the limit of two consecutive electoral terms for the President of the Region also applies to the autonomous regions, a principle that had already been established with regard to ordinary regions in Judgment No. 64/2025. This article aims to reconstruct the evolution of the form of government within the autonomous regions. Its purpose is to determine whether these regions may be regarded as institutional laboratories in which the democratic principle can be articulated in a manner consistent with the needs, specific characteristics, and historical-institutional trajectories of their respective territories.
