The paper examines cases of both formal and substantive deconstitutionalization in the regulation of constitutional matters, focusing specifically on the failure of constitutional laws to recognize new fundamental rights, as well as on the largely unfinished regulation in the Charter of the relations between the state and the European Union on the one hand, and the state and the regions on the other, especially with regard to cooperation institutions. Finally, it dwells on the cases of substantive deconstitutionalization due to deficiencies in constitutional language, resulting in an imbalance in the relationship between the Constitution and politics and, therefore, with immediate and serious repercussions for the weak subjects.
