The contribution, after situating the phenomenon of electoral abstention within the broader crisis dynamics of representative democracy – considered in light of the paradigm of the “crisis of the represented” (M. Luciani) and Pierre Rosanvallon’s reflections on “counter‑democracy” – examines the scope of the constitutional principle of voting as a “civic duty” (article 48, second paragraph, second sentence, Italian Constitution). Drawing on the reconstruction of the debate within the Constituent Assembly and on selected doctrinal positions, the essay advances a magis ut valeat interpretation of this constitutional formula, addressing both the potential justiciability of the civic duty to vote and – also with a brief comparative glance at foreign experiences – the possible avenues for its legislative implementation.
