L’emergenza sanitaria ha determinato un vero e proprio cortocircuito nel rapporto biunivoco tra diritti (quelli degli studenti) e doveri (quelli della Repubblica) che nella scuola si incontrano e si intersecano. Un cortocircuito a cui la didattica a distanza non è riuscita a porre rimedio, essendo la scuola innanzitutto un luogo “fisico”, in cui i ragazzi crescono e si formano. La questione se il diritto all’istruzione debba considerarsi recessivo rispetto al diritto alla salute, in quest’ottica, appare riduttiva, poiché la domanda da porsi è se le istituzioni abbiano fatto tutto ciò che dovevano e potevano per evitare di venir meno ai doveri inderogabili imposti loro dalla Carta Costituzionale.  

The health emergency led a real blackout  into the  relation between  students’ rights and Republic’s duties that have met and intersected in the school up to now. A short circuit that distance learning has not been able to remedy, since the school is above all a “physical” place, where children grow and form.
In this view , the question of whether the right to education should be considered recessive than the right to health,  seems reductive, since the question the question to be asked is whether the institutions have done everything they should and could to avoid failing in their mandatory duties imposed on them by the Constitutional Charter.
