Il lavoro indaga il profondo tema del diritto umano alla vita privata e familiare, contemplato dall’art. 8 della CEDU e art. 7 della Carta dei diritti fondamentali dell’Unione europea, declinato quale diritto di stabilire relazioni con altri esseri umani, di sviluppare la propria personalità e quale libertà di autodeterminazione. Ed al quale si affianca il diritto di costituire una famiglia, il diritto del minore a crescere nella propria famiglia e ad avere una famiglia (artt. 9 e 12 della CEDU). Un caso emblematico è offerto dal complesso e violento dibattito sul matrimonio e sulla famiglia poligamica, nei suoi tropo spesso drammatici epiloghi.

The work investigates the profound theme of the human right to private and family life (art. 8 CEDU and art. 7 of the Charter of Fundamental Rights of the European Union), expressed as the right to establish relationships with other human people, to develop one’s personality and as freedom of self-determination. This right is accompanied by the right to form a family, the right of the minor to grow up in his family and to have a family (arts. 9 and 12 of the ECHR). An emblematic case is offered by the complex and violent debate on marriage and the polygamous family, in its all too often dramatic epilogues.
