Il contributo – adottando un approccio informatico-giuridico e giusfilosofico – intende portare l’attenzione sulle significative questioni riguardo le armi LAWS (Lethal Autonomous Weapons System). In un primo momento, dopo aver delineato le definizioni di LAWS, di autonomia dei sistemi nonché di agente software, verranno indagate alcune tipologie di armi terra-mare LAWS, ponendo una specifica attenzione sull’utilizzo dei droni. Procedendo in questa direzione, ci si soffermerà su alcuni aspetti della Società algoritmica e sulle difficoltà ad attribuire delle responsabilità nei casi degli attacchi con effetti collaterali. In conclusione, si argomenterà su un’ipotesi di regolamentazione di tali armi tramite il concetto di regola regolativa, sull’ipotetico inserimento di una manopola etica in tali sistemi e su alcune brevi riflessioni sull’etica militare, minacciata dalla pervasività della tecnica.

This paper aims to draw attention to the significant issues surrounding LAWS (Lethal Autonomous Weapons System) weapons, using a legal informatics and legal-philosophy approach. In a first step, after outlining the definitions of LAWS, autonomous systems and software agents, some types of ground-to-sea LAWS weapons will be examined, with a special focus on the use of drones. This will be followed by a discussion of the central aspects of the algorithmic society and the difficulties of attributing responsibility in the case of attacks with significant collateral effects. Finally, a hypothesis for the regulation of these weapons, the inclusion of an ‘ethical knob’ in such systems, and some of the challenges these weapons pose to the military will be discussed.
