Le situazioni familiari che costituiscono un punto di criticità per la tutela del minore sono in aumento nel contesto sociale attuale, caratterizzato dalla coesistenza di un significativo pluralismo e multiculturalismo non sempre luoghi di incontro. L’ordinanza del Tribunale di Bari del 27 maggio 2022 (R.G. 11140-1/2021) offre lo spunto per affrontare sotto altro profilo la problematica riguardante i diritti del minore in riferimento alla educazione religiosa e all’esercizio del diritto corrispondente da parte del minore. La regolamentazione giuridica dell’interesse del minore impone una preferenza per quei valori che favoriscono la sua crescita, eliminando qualsiasi situazione di disagio che si viene a creare, e richiede anche di ridisegnare la responsabilità genitoriale. Prendere in considerazione i diritti del minore, considerato nella sua totalità, facendo riferimento anche alle peculiarità delle varie situazioni, con una maggiore definizione delle tipologie di disagio può favorire in maniera concreta una tutela piena dei minori stessi, veri protagonisti di tali vicende.
