L’articolo trae spunto dalla recente ordinanza interlocutoria n. 28086/2018 con cui la Terza Sezione della Corte di Cassazione ha deciso di rimettere la questione alle Sezioni Unite in quanto involgente tematiche di particolare importanza. La decisione mostra l’importanza del tema trattato e la difficoltà di operare un ragionevole bilanciamento fra la libertà di stampa ed il diritto all’oblio

The paper is inspired by the recent interlocutory ordinance n. 28086/2018 with which the Third Section of the Court of Cassation decided to refer the matter to the United Sections because of its particular importance. The decision shows the importance of the subject dealt with and the difficulty of making a reasonable balance between freedom of the press and the right to be forgotten.
