Nei sistemi giuridici contemporanei di civil law sempre più spesso si assiste al fenomeno della co-produzione normativa da parte dei giudici, mediante l’utilizzo di tecniche di interpretazione sempre più sofisticate. Nel tentativo di limitare tale fenomeno ogni sistema giuridico ha elaborato soluzioni diverse, talune molto interessanti. L’analisi della giurisprudenza del Tribunale costituzionale spagnolo offre in proposito molti interessanti spunti di riflessione.

In the contemporary juridical systems of civil law more and more often we witness the phenomenon of normative co-production by the judges, through the use of more and more sophisticated techniques of interpretation. In an attempt to limit this phenomenon, every legal system has developed different solutions, some very interesting ones. The analysis of the case law of the Spanish Constitutional Tribunal offers many interesting points of reflection in this regard.
