La rielezione di Sergio Mattarella a Presidente della Repubblica, la seconda nella storia della Repubblica, oltre a testimoniare una crisi della politica, offre l’occasione per tornare su un tema molto dibattuto in dottrina: la rieleggibilità del Capo dello Stato. In questo breve contributo, dopo aver ricostruito le varie opinioni dottrinali sul tema, si cercherà di dimostrare che la rieleggibilità del Presidente della Repubblica strida con il principio di temporaneità delle cariche pubbliche, sotteso al principio democratico che informa la nostra Costituzione. Si darà, poi, conto del dibattito che si è aperto a seguito di tale rielezione, analizzando le varie proposte di modifica costituzionale prospettate.

The re-election of Sergio Mattarella as President of the Republic, the second in the history of the Republic, as well as witnessing a crisis of politics, offers an opportunity to return to a theme much debated in doctrine: the re-election of the Head of State. In this short contribution, after having reconstructed the various doctrinal opinions on the subject, we will try to prove that the re-electability of the President of the Republic clashes with the principle of temporariness of public office, underlying the democratic principle that underpins our Constitution. It will then give an account of the debate that has opened up following this re-election, analysing the various proposed constitutional changes.
