Le misure adottate dal governo per contrastare la pandemia continuano a generare dubbi e perplessità in ordine alla loro compatibilità con il quadro costituzionale, in assenza di un espresso obbligo di vaccinazione. L’approccio graduale con il quale si è giunti alla recente introduzione del c.d. super green pass di fatto ha consentito di conseguire l’obiettivo di incrementare la vaccinazione, ma allo stesso tempo ha contribuito ad alimentare una maggiore confusione in un contesto di emergenza nel complesso bilanciamento tra il diritto alla salute e le altre libertà fondamentali. 

The measures adopted by the government to combat the pandemic continue to raise doubts and perplexities in terms of their compatibility with the Constitution, in the absence of specific mandatory vaccination. The gradual approach leading up to the recent introduction of the so-called “super green pass” has de facto made it possible to achieve the goal of increasing the numbers of vaccinated, but at the same time has contributed to fuelling greater confusion in an emergency situation, in the complex balancing act between the right to heath and other fundamental freedoms.
