Il saggio, alla luce dell’attuale emergenza sanitaria e a fronte di numerosi strumenti giuridici che, in tale contesto, di fatto limitano diritti e libertà fondamentali, riflette sull’attualità della nozione di atto politico, cosi come era strutturato nel pensiero di Oreste Ranelletti nei primi anni del Novecento, consistente in un atto d’imperio emanato dal potere politico per realizzare altissime e supreme esigenze dello Stato, ma slegato da vincoli e controlli. Quello che era ipotizzabile cento anni fa certamente non lo è più oggi, alla luce dei valori espressi dalla Costituzione e dal diritto europeo.

The essay, in the light of the current health emergency and in the face of numerous legal instruments that, in this context, limit fundamental rights and freedoms, reflects on the current notion of a political act, just as it was structured in the thinking of Oreste Ranelletti in the early 20th century. It consisted of an act of authority emanating from political power to realize the highest and supreme needs of the state, but detached from constraints and controls. All this, conceivable a hundred years ago, certainly is no longer so today, in the light of the values expressed by the Constitution and European law.
