Il lavoro analizza i problematici rapporti tra diritto penale post-moderno e Costituzione sui  versanti del diritto penale “multilivello”, dell’interpretazione “creatrice” giurisprudenziale e del populismo penale, nelle sue varie forme, concludendo nel senso della necessità di considerare la Costituzione come “stella polare” dell’interpretazione.

The work analyses the problematic relations between criminal law postmodern and Constitution on the slopes of the criminal law “multilevel”, of the “creative interpretation” and of the penal populism, in its various forms, concluding in the sense of the need to consider the Constitution as “Pole Star” of the interpretation.
