La questione del diritto di voto dei c.d. fuori sede coinvolge numerosi gruppi di cittadini, che non possono esercitare un diritto costituzionalmente garantito per ragioni di lavoro, di cure mediche o di studio. La presente indagine intende ricostruire la normativa vigente sull’esercizio del diritto di voto ‘fuori sede’ dei cittadini in Italia e all’estero, valutando la ragionevolezza delle scelte del legislatore ed avanzando alcune proposte che rafforzino il profilo dell’effettività del godimento del diritto.

The issue of the right to vote of so-called fuori sede citizens involves numerous groups of individuals who are unable to exercise a constitutionally guaranteed right for reasons of employment, medical treatment, or study. This paper seeks to reconstruct the existing legal framework governing the exercise of the right to vote “away from one’s place of residence” by Italian citizens, both domestically and abroad. It further evaluates the reasonableness of the legislator’s choices and advances several proposals aimed at strengthening the effective enjoyment of this right.
